Effective from: 2025.05.05
These General Terms and Conditions (hereinafter: GTC) contain the terms of use of the PostInsight cloud-based social media content analysis and suggestion software powered by artificial intelligence (hereinafter: Software), available at
https://postinsight.ai (hereinafter: Website), operated by … Limited Liability Company (hereinafter: Service Provider), as well as the rights and obligations of the user using the electronic commerce services detailed in this GTC related to the use of the Software (hereinafter collectively: Service) and the Service Provider. (Service Provider and User hereinafter collectively: Parties.)This GTC applies to the use of the Service Provider's services. By checking the relevant box during registration on the Website or by using the Software, the User accepts the provisions of this GTC, and is therefore required to read it carefully before using the Software.
Operating and complaint handling location of the Service Provider:
https://postinsight.aiThe Service Provider continuously improves the functionality of the Software to ensure it remains technologically up-to-date and user-friendly.
There are no subscription tiers for Users; the system offers both paid (credit-based) and free (using credits provided upon registration) usage options. The provisions of the GTC apply equally to all registered Users.
To use the Service, the User must register on the Website via Facebook account authentication. Upon registration, a User account is created. Registration is deemed successful once Facebook authentication is completed and the system has created the User’s unique account.
The Service may be used by any natural or legal person, or legal entity without legal personality. The term User also includes consumers. A consumer is a natural person who acts outside their trade, profession, or business activity as defined in the Civil Code (Act V of 2013).
Upon registration, the system automatically creates the User Account, which stores credit balances and provides access to generated content.
During the term of this agreement, the Service Provider ensures access to the Services defined in point 1.1. Use of the Software is provided under a license that is non-transferable and may only be used by the registered User. The Service Provider maintains and develops the Software continuously, including fixing technical issues and adapting to API changes of social media platforms.
The Service Provider provides customer support related to the use of the Software primarily via e-mail. The details of the service packages (hereinafter: Packages) – especially the content, price, and usage terms of each credit package – are included in the annex of this GTC and in the “Pricing” section of the Website. All listed prices are gross amounts.
The use of the Service – following the use of the 10 gift credits granted upon registration – is subject to a fee. The User pays the fee through the Stripe payment system based on the selected credit package. The Service Provider reserves the right to modify the prices and the GTC, which takes effect upon publication on the Website.
No registration is required to browse publicly available content on the Website (https://postinsight.ai).
Only registered Users are entitled to use the Services. Registration takes place on the Website through Facebook account authentication. During registration, the Service Provider automatically creates the User account, which allows access to the Services, purchase of credits, and review of previous queries.
During registration, the system uses public data from the User’s Facebook account (e.g., name, email address), for which the User is solely responsible. The Service Provider excludes all liability for any damages resulting from incorrectly, outdated, or falsely provided data. The User is responsible for the security of their password and Facebook account; the Service Provider is not liable for any unauthorized access resulting from this.
Credit purchases are made within the User Account via the Stripe payment system. During purchase, the User selects the desired credit package and is redirected to Stripe’s payment interface to complete the transaction with a bank card.
The Service Provider reserves the right to refuse registration or terminate a User account without explanation, especially if the User acts unlawfully or contrary to the purpose of the Service.
Registration is considered valid once Facebook account authentication is completed and the Service Provider has created the User account. After registration, the system automatically grants 10 free credits, which can be used for testing purposes.
During the credit purchase process, the User can review the details and gross price of the selected package before finalizing the order. Before payment, the User may cancel or modify the order. Upon successful transaction, the purchased credits are automatically credited to the User Account.
The registration process is as follows:
The User initiates the registration process by clicking the "Login with Facebook" button on the Website homepage.
The system redirects the User to Facebook’s authentication page, where the necessary permissions must be granted (e.g., access to social media account data).
After authentication, the system automatically creates the User Account, and the initial 10 credits are credited.
With the completion of registration, the Agreement enters into force in accordance with the present GTC.
Upon successful registration, the system automatically creates the User’s personal User Account. Within the account, the User can access their credit balance, previous transactions, and queries. For certain payment operations (e.g., credit purchase), the User is redirected to the Stripe payment interface, where the transaction is completed. The use of Stripe is governed by the provider’s own terms of use.
Within the User Account, the User may perform the following actions:
The PostInsight system does not offer subscriptions or package options. The service operates on a credit basis, and the current number of credits required for queries is described on the Website.
Credit purchase process:
Credits can be purchased in the “Credits” section of the User Account by clicking the “Buy Credits” button.
The User selects the desired credit package (e.g., 25, 50, 100 credits), then by clicking “Continue” or “Pay,” is redirected to the Stripe payment interface.
Payment is made by bank card based on the data provided on the Stripe interface. After successful payment, Stripe redirects the User back to the Website.
The purchased credits are automatically credited to the User Account after successful payment and can be used immediately.
The User Account may be deleted at any time via the “Delete Account” function available in the account settings or by sending a written statement to the Service Provider. Upon deletion, all data, queries, and unused credits associated with the account are permanently deleted. Previously purchased credits are not refundable in cash.
After registration, every new User automatically receives 10 free credits, which can be used to try the PostInsight service. The free credits can only be used once and cannot be exchanged for money.
Continued use of the PostInsight service is only possible by purchasing credits. Credits are digital currency units used to access services provided by artificial intelligence (e.g., post analysis, text or image suggestions, comment replies). Each operation deducts a specific number of credits, detailed in the “Pricing” section of the Website.
The User can select the desired credit package in their User Account. The purchase is made through the Stripe online payment system using a bank card. By finalizing the purchase, the User consents to payment using the provided card data.
Online payments are processed by Stripe Payments Europe Ltd. (https://stripe.com/en-hu/privacy). Stripe’s system handles bank card payments, and its security protocols apply. The Service Provider does not process or store bank card data.
Payment is considered completed when the paid amount is received by the Service Provider through the Stripe system. Credits are automatically credited after successful completion of the transaction.
The Service Provider reserves the right to reject transactions in case of incorrectly displayed prices – especially in case of technical errors, typos, or zero-value prices – and may offer purchase at the correct price. In such cases, the User has the right to withdraw from the purchase.
Purchased credits do not expire and may be used by the User at any time while the User Account is active, unless they are deducted by the system as part of using the service or the account is terminated or suspended under this GTC.
The Service Provider sends an electronic invoice to the User's email address within a maximum of 8 business days after a successful transaction and also makes it available in the User Account.
In the PostInsight system, a credit is a digital currency unit required to access various AI-based services. The credit cost of services is as follows:
Credits are available in various packages (e.g., 25, 50, 100 credits). The currently available packages and their prices are listed in the “Pricing” section of the Website.
Credits are not time-limited – they may be used as long as the User Account is active, or until the system deducts them as part of service use.
Credits cannot be transferred to other users, cannot be refunded for money, and are lost if the User Account is deleted or permanently suspended.
The Service Provider is obliged to ensure the proper functioning of the Software for the User during the term of the Agreement and strives for continuous development and error-free operation.
The Service Provider provides updates and modifications of the Software to Users free of charge. Updates may include technological changes and changes resulting from legal compliance. The Service Provider does everything possible to ensure legal compliance, but the User is responsible for lawful use of the Software.
The Service Provider is not required to provide continuous customer support, maintenance, or individual technical assistance. Questions related to the Software’s functionality may be submitted via the contact channels listed on the Website.
The Service Provider is entitled to verify the data provided during registration, particularly to prevent abuse and ensure proper use of the Software.
The User is entitled to use the Software if they are registered, have a valid User Account, and possess sufficient credit balance.
The User may use the Software solely in their own name and for their own purposes. The service is non-transferable and access cannot be granted to third parties without the prior written consent of the Service Provider.
The User is obliged to keep the data in their User Account up to date. Invoices issued by the system are always based on the data recorded at that time. Subsequent modifications to invoices are not possible.
Under the Agreement, the User obtains a non-exclusive, non-transferable, time-limited license to use the Software on their own devices solely for personal use, in the manner defined in the GTC.
During the use of the Software, the data, texts, images, comments, etc. provided by the User serve as Inputs for the system. Based on these, the artificial intelligence generates an Output – for example, a suggested post, image, or comment reply. Together, the Input and Output constitute the User Content (hereinafter: Content).
The User bears exclusive responsibility for the Input. It is prohibited to provide any data or files that:
The Service Provider is entitled to delete such Inputs or the Content generated from them immediately and to suspend or terminate the User Account.
The Output may not legally qualify as a copyrighted work and may not be unique or exclusive. The Service Provider does not guarantee that the Output will not infringe the rights of third parties or comply with all applicable laws. The use of the Output is at the User’s own risk.
It is prohibited to reverse engineer or analyze the PostInsight Software technology, including the underlying artificial intelligence models, algorithms, training data, or to use them for data collection or the development of a competing service.
The User may not state or imply that the content generated by artificial intelligence was created by a human, especially if such communication would be misleading or constitute unfair commercial practice.
The User is required to provide accurate data during registration. The Service Provider assumes no liability for damages arising from incorrect, incomplete, or false data, including resulting technical or legal issues.
Use of the Software and the resulting Content is at the User’s own risk. The Service Provider is not liable for direct or indirect damages incurred by the User while using the Software, particularly in cases of loss of business information, revenue loss, data loss, or interruption of operations. The Service Provider’s liability is limited to the value of the credits purchased by the User during the disputed period.
The User is solely responsible for their own actions and the Content created with the Software. The Service Provider assumes no liability for violations committed by the User but is obliged to cooperate with the competent authorities during any related proceedings.
The User is obliged to indemnify the Service Provider for any claims, losses, or damages resulting from unauthorized or unlawful use of the Software, the Content, or a breach of the GTC.
The Service Provider provides the Software and related services on an “as is” basis and does not guarantee that they are error-free, uninterrupted, or meet every specific expectation of the User.
Third-party services related to the Software – particularly Stripe and Facebook – operate under their own terms of use. The Service Provider assumes no responsibility for their operation, errors, or consequences thereof.
The User is responsible for the accuracy and timeliness of any data entered on the Website or within the Software. The Service Provider shall not be liable for any damages resulting from incorrect data.
The Service operates through telecommunications infrastructure. The Service Provider is not liable for service interruptions, quality degradation, or disruptions caused by failures in telecommunications services.
If the User is a natural person, this contract qualifies as an off-premises contract, and the relevant legal provisions apply.
The contract between the Parties is governed by the Civil Code and Government Decree 45/2014 (II. 26.).
The Service Provider declares that the mandatory information required by the Government Decree is included in this GTC, which the User reviews and accepts during registration.
By registering and purchasing credits, the User expressly requests that the Service Provider begin providing the digital service before the expiration of the withdrawal period. The User acknowledges that they forfeit their right of withdrawal once the service begins.
The User is entitled to withdraw from the contract within 14 days of its conclusion without providing a reason.
The right of withdrawal may be exercised using the template declaration in Annex 2 of the GTC or any other unambiguous written declaration, which must be sent to the Service Provider electronically or by mail.
The deadline is deemed met if the withdrawal declaration is sent before the 14-day period expires.
If the service provision has begun (e.g., AI request using credits), the right of withdrawal is forfeited. No refund is provided for partially fulfilled services.
In the event of defective performance by the Service Provider, the User may assert warranty claims in accordance with the provisions of the Civil Code.
The User may request the correction of the defect or, in exceptional cases, a proportionate reduction of the fee. Withdrawal is not permitted in the case of insignificant defects.
The defect must be reported without delay after its discovery, but no later than two months. Warranty claims cannot be enforced more than one year (two years for consumers) after the date of performance.
Warranty claims may be reported via the contact information provided by the Service Provider.
In the case of a natural person User, during the first year after the contract is concluded, the Service Provider is only exempt from liability if it proves that the defect arose after performance. Thereafter, or in the case of legal entities, the burden of proof lies with the User.
Users may submit complaints related to the use of the Service free of charge via any of the contact methods specified in the GTC. The Service Provider strives to handle complaints quickly, transparently, and lawfully.
In the case of a verbal complaint (e.g. by phone), the Service Provider shall immediately examine the complaint and, where possible, remedy it without delay. If this is not possible, or the User does not accept the solution, the Service Provider shall record the complaint in a report, which is reviewed with the User, and a copy is provided to the User.
Complaints submitted in writing (via e-mail) are investigated by the Service Provider, who will respond within 30 days. The response will be sent in a clear and reasoned format. Complaints and related documentation are retained by the Service Provider for 5 years.
If the complaint is rejected or no response is received within the deadline, the User may resort to the following legal remedies:
During the performance of the Agreement, the Parties shall cooperate and send their notifications via the following contact details:
If the Service Provider is unable to provide the service due to its own fault, it shall immediately inform the User and refund the value of the service already paid for but not used on a pro-rata basis.
The GTC constitutes the full agreement between the Parties. Issues not regulated herein do not form part of the Agreement.
Any fact that affects the agreement between the Parties and is recorded in the GTC is considered a material term of the contract.
The Service Provider shall take all reasonable measures to ensure the secure use of the Website, but the User is responsible for maintaining the security of their own devices (e.g. antivirus, updates).
The Service Provider is not liable for damages arising from connecting to the Website. The protection of computing devices and data is the responsibility of the User.
The Service Provider does not submit to any voluntary code of conduct.
The Parties shall seek to resolve their disputes primarily through peaceful means. If this is unsuccessful, legal disputes shall be settled by the competent Hungarian courts.
The Parties agree that their legal relationship shall be governed by Hungarian law, in particular the Civil Code and other relevant Hungarian legislation.
